Does the defaulting party have any rights after termination?
ایا طرف مقصر بعد از فسخ قرارداد حقی دارد ؟



This is a fact that a party to a contract has committed a breach does not deprive them of all rights arising from the contract.

A defaulting party may claim damages for any breach committed by the other party prior to termination of the contract.

A defaulting party can also recover sums paid, but the ability to recover monies paid will depend on the terms of the contract, and the nature of the sum paid.

More particularly, whilst a deposit is not usually recoverable by a defaulting party, an instalment payment will be recoverable where it is treated as being paid conditionally, upon completion or performance of the contract.



حقیقت این است که یک طرف قرارداد که مرتکب نقض گردیده است ، از کلیه حقوق ناشی از قرارداد محروم نمی گردد .

یک شخص مقصر می تواند ادعای خسارات برای هر گونه نقض  طرف دیگر قبل از فسخ قرارداد را بنماید.

طرف مقصر می تواند درخواست اعاده وجوه پرداختی را بنماید .

البته توانایی در اعاده وجوه پرداختی بستگی به شروط قرارداد و ماهیت وجه پرداختی دارد .

بطور دقیق تر در حالیکه یک مبلغ بیعانه غالبا توسط شخص مقصر قابل اعاده نمی باشد ، یک پرداخت اقساطی در جایی که منظور از ان پرداخت به صورت مشروط بوده  (به عنوان مثال در زمان تکمیل و یا اجرای قرارداد ) ، قابل اعاده می باشد .
