حقوق مداخله :

Step-in rights enable one party (the beneficiary) to 'step in' to the shoes of another party in relation to the rights and obligations of a contract, typically, if there has been a serious breach of contract. Step-in rights can be used to enable a project to continue with one party being replaced by another.

منظور از این اصطلاح در قراردادها توانایی مداخله یکی از طرفین در حقوق و مسئولیت های طرف دیگر در هنگام نقض اساسی قرارداد توسط وی می باشد.
این حق همچنین می تواند  ادامه اجرای پروژه را توسط شخصی دیگر فراهم نماید.

16.4 Step-in Rights:

Notwithstanding and in addition to the other rights and remedies available to the MEP Participants, including those under the Government Guaranty, those available at law and those expressly provided under this Agreement, after an Event of Default by the Turnkey Contractor, the MEP Participants shall have the right, but not the obligation, to step in and assume full control over the Facilities and the Work.


16.5 Consequences of Step-in:

The exercise of any step-in rights under Section 16.4 shall not discharge any of the Turnkey Contractor’s obligations or preclude or prejudice the ability of the MEP Participants from exercising any other remedy, including the warranties and guaranties hereunder and recourse to the Government Guaranty. The Turnkey Contractor shall provide all data and project materials to the new project manager designated by the MEP Participants. At the MEP Participants’ request, all Subcontracts shall be promptly assigned or legally and effectively transferred to the MEP Participants.

همانطور که ملاحظه می شود استفاده از این شرط به هیچ عنوان باعث مبرا شدن پیمانکار از مسئولیت های خود نمی باشد و وی ملزم به ارائه اطلاعات  و مصالح پروژه به مدیر پروژه جدید می باشد .

همچنین کلیه پیمانکاران فرعی نیز باید فورا جهت ادامه کار به پروژه انتقال داده شوند .
